In June 2014, a California Superior Court ruled that several teacher tenure protections in California violated the constitutional right of students, particularly low-income and minority students, to gain access to effective teachers. Even as this legal decision goes through the appeals process, advocates in various states are preparing to file similar lawsuits to give schools greater control over the dismissal of ineffective teachers. This panel will discuss the significance of this legal case for our national debate about the role of unions in the teaching profession and the movement toward greater accountability for student outcomes. We will debate how Vergara v. California altered the political, legal and advocacy landscape around teacher tenure and what we can expect moving forward.
